Rules for purchase and sale in the online store “99projects.eu”
- Concepts
1.1. Seller – an individual or legal entity specified in the Order of goods, whose goods are sold on the website www.99projects.eu in accordance with these Rules, and which is responsible for fulfilling the order placed by the Buyer. The details of the Seller with whom the purchase and sale agreement for the relevant goods is concluded in accordance with these Rules are indicated in the order for the Goods.
1.2.www.99projects.eu– website located atwww.99projects.eu, where goods are sold and which is administered by the private legal entity MB “Mprint printers”, registered in the Register of Legal Entities of the State Enterprise “Center of Registers” of the Republic of Lithuania, legal entity code: 306335738, VAT payer code: LT100016031010, registered location address: A. Stulginskio g. 41 G, 48313 Kaunas, Lithuania, correspondence address: A. Stulginskio g. 41 G, 48313 Kaunas, Lithuania. 99projects.eu in relation to the goods sold by it in these Rules is also understood as the Seller.
1.3. Buyer – 1) a legally capable individual, i.e. a person who has reached the age of majority, whose legal capacity is not limited by the court; 2) a minor between fourteen and eighteen years of age who has the consent of his parents or guardians, unless he is emancipated; 3) legal entity.
1.4. Parties – Buyer and Seller jointly.
1.5. Personal data – any information about an individual whose identity has been established or can be identified (data subject); an identifiable natural person is a person whose identity can be determined directly or indirectly, primarily by an identifier such as a first and last name, personal identification number, location data and Internet identifier, or by one or more physical , physiological, genetic, mental, economic, cultural or social characteristics of the personality of a given individual.
1.6. Rules – these “Rules for the purchase and sale of goods of 99projects.eu”, which apply to each purchase made by the Buyer on 99projects.eu, and to each Sales Agreement concluded between the Buyer and the Seller.
1.7. Account is the result of the Buyer’s registration on 99projects.eu, carried out on the basis of the Terms of Use of www.99projects.eu, in relation to which a personal account is created for the Buyer, saving his personal data and order history.
1.8. Privacy Policy is a document approved by 99projects.eu, which provides the basic rules for the collection, accumulation, processing and protection of Personal data when using 99projects.eu. The privacy policy of 99projects.eu does not cover the processing of Personal data when the processing of such data is carried out by the Seller. The processing of Personal Data carried out by the Seller is carried out in the manner established by the Seller. Before purchasing goods and concluding this agreement with the Seller, the Buyer must carefully read the rules for processing personal data applied by the Seller.
1.9. Agreement – a contract for the purchase and sale of the relevant Goods, concluded between the Buyer and the Seller, which is considered concluded from the moment the order is submitted. It is considered that the terms of each Agreement concluded between the Buyer and the Seller are identical to the terms of the Rules valid at the time of submission of the order,and such Agreements are executed by the parties at all times in accordance with the Rules in force at the time of submission of the order.
1.10. Order – an order for Goods, which specifies the Goods that the Buyer wishes to purchase from the Seller, specified in the same order.
- General provisions
2.1. The buyer confirms the Rules, that he has read them, by ticking the statement “I have read the rules for the purchase and sale of goods on 99projects.eu and agree with them.” The Rules thus approved are a legal document binding on the Parties, which establishes the rights and obligations of the Buyer and Seller, the conditions for the purchase and payment for goods, the procedure for delivery and return of goods, the responsibilities of the parties, as well as other conditions related to the purchase and sale of goods on 99projects.eu.
2.2. By creating an account on 99projects.eu, the Buyer confirms the Rules during the first registration. After the Buyer confirms the Rules during the first registration (account creation), the Rules apply to all purchases of the Buyer made on 99projects.eu and to all Agreements concluded with Sellers until the updated Rules are announced on www.99projects.eu. After updating the Rules, they apply from the moment they are announced onwww.99projects.eu, and the Buyer will learn about the update of the Rules in the manner provided in clause 2.4.
2.3. Only Buyers have the right to make purchases on 99projects.eu, as described in clause 1.3 of the Rules. The buyer, who confirms the Rules and that he has read the Privacy Policy (clause 2.4 of the Rules), as well as the Rules of Use of 99projects.eu, confirms that he has the right to purchase goods on 99projects.eu.
2.4. In the event of changes in market conditions or in the presence of circumstances provided for in the legal acts of the Republic of Lithuania, 99projects.eu has the right to change, amend and supplement the Rules. Buyers will be informed about this when connecting to their Account or www. 99projects.eu, or when they form a basket of goods, however, in all cases after updating the Rules, the Buyer can submit an order only if he has read and confirms the Rules of the new edition.
2.5. The Buyer is obliged to familiarize himself with the Privacy Policy approved and publicly disclosed by 99projects.eu. The Buyer's Personal Data will also be transferred to the Seller from whom the Buyer purchases the Products, and the processing of such Personal Data will be carried out in the manner established by the Seller specified in the order, as well as in compliance with the data security obligations assumed under the contract between 99projects. eu and the Seller.
2.6. If the Seller has the right or obligation to provide the Buyer with information or documents by email, in all cases the Buyer is responsible for providing a valid Buyer-owned email address to the Seller.
- Ordering Goods, the moment of creation of legal relations of purchase and sale
3.1. The buyer can order goods on 99projects.eu by choosing one of the following methods:
3.1.1. via the Internet with registration on 99projects.eu (entering your registration name and password);
3.1.2. via the Internet without registering on 99projects.eu;
3.2. The Buyer, ordering goods using one of the methods specified in clauses 3.1.1-3.1.2 of the Rules, in the relevant information fields presented in the 99projects.eu system, is obliged to indicate his Personal data necessary for the proper execution of the order for goods, the processing of which is carried out by 99projects .eu is carried out in the manner provided in the Privacy Policy.
3.3. Orders for goods submitted by telephone or in Stores are processed in the manner established in the Rules, and the provisions of the Privacy Policy apply to them. By submitting an order, the Buyer agrees to the Rules and their application.
3.4. When the Buyer, having selected the product or service to be purchased and formed a basket of goods, completes all the steps of the order, the last of which is the selection and confirmation of the payment method, it is considered that a legal sales relationship arises between the Seller and the Buyer and a sales contract is concluded. The Buyer is informed of the order confirmation by providing a notification to the email address provided by the Buyer. The Seller sends the Buyer a link to the current Rules along with the order confirmation to the email address specified by the Buyer.
3.5. Instructions for the goods ordered by the Buyer in Lithuanian are provided no later than at the time of delivery of the goods, to the email address specified by the Buyer. All essential information about the product and its properties is provided in the Seller’s product description on 99projects.eu. In case of purchasing goods in physical stores of 99projects.eu, product instructions, if necessary, taking into account the nature of the goods, will be provided along with the goods.3.6. Each Buyer's order is stored on 99projects.eu and in the Seller's database in the manner specified in their Privacy Policy.
- Buyer's rights
4.1. The buyer has the right to purchase goods and order services on 99projects.eu in the manner prescribed by these Rules.
4.2. The buyer has the right to refuse the order in the manner prescribed by these Rules.
4.3. The Buyer has the right to withdraw from the Agreement in the manner prescribed by these Rules.
4.4. The buyer has the right to replace or return purchased goods in the manner established by these Rules.
4.5. The Buyer has other rights contained in these Rules, the Privacy Policy, the Rules of Use of 99projects.eu and the legal acts of the Republic of Lithuania.
- Obligations of the Buyer
5.1. The Buyer, using 99projects.eu, is obliged to fulfill his obligations, comply with these Rules, the Privacy Policy, the Rules of Use of 99projects.eu, other conditions clearly indicated on 99projects.eu, and also not violate the legal acts of the Republic of Lithuania.
5.2. The Buyer is obliged to pay for the ordered goods or services and accept them in the manner prescribed by these Rules. If the Buyer chooses the method of receiving goods in the Store, he is obliged to pick them up at the selected Store within the time limits specified in the Rules.
- Rights of the Seller
6.1. The Seller and 99projects.eu have the right, without prior notice to the Buyer, to cancel his order if the Buyer, having chosen the payment methods provided for in clauses 8.2.1 or 8.2.2 of the Rules, does not pay for the goods within 3 (three) working days.
6.2 . When the Buyer chooses the payment method provided for in clause 8.2.3 of the Rules, the Seller, in case of any ambiguity regarding the information provided in the order, has the right to contact the Buyer through 99projects.eu using the details specified in the order. In this case, the countdown of the delivery time for goods begins with establishing contact with the Buyer. Buyer's order may be canceled without prior notice if: (i) Seller fails to contact Buyer within two (2) business days after the order is submitted, or (ii) Buyer fails to provide Seller with the requested information within the time period specified by Seller, or (iii) The Buyer does not provide the Seller with consent to process his personal data.
- Obligations of the Seller
7.1. The Seller undertakes to fulfill the Buyer’s orders in the manner established in these Rules, to communicate with the Buyer using 99projects.eu (if the order was submitted in the manner provided for in clause 3.1.1) or through the contact information specified by the Buyer (when the order was submitted by one of methods provided for in paragraphs 3.1.2-3.1.2).
7.2. The Seller undertakes to clearly and understandably provide the Buyer in the 99projects.eu system with the information provided for in Article 6.228-7 of the Civil Code of the Republic of Lithuania.
7.3. The Seller and 99projects.eu undertake to respect the Buyer’s privacy and process the Buyer’s Personal Data only in the manner prescribed by these Rules, the Privacy Policy, the 99projects.eu Rules of Use and the legal acts of the Republic of Lithuania and the European Union.
7.4. 99projects.eu undertakes to inform the Buyer about the suspension or termination of the functions of 99projects.eu before submitting the order. Providing information in a 99projects.eu Account or on the 99projects.eu e-commerce website is considered proper communication. When the Buyer's order has already been accepted for execution, the Buyer is informed about the suspension or termination of functions of 99projects.eu that are significant for the execution of the order via one of the contact details specified by the Buyer (by phone, SMS message or email).
7.5. Guided by the conditions provided for by the Rules, the Seller undertakes to provide the goods ordered by the Buyer and accept the goods returned by the Buyer.
7.6. In exceptional cases, in the presence of objectively justified circumstances that the Seller could not foresee and control in advance, delivery of goods may be delayed or become impossible. In this case, the Seller undertakes to immediately contact the Buyer regarding the possibilities of further implementation of his order. The Seller may offer the Buyer a similar or similar product that is sold by another Seller, informing about this using one of the contact details specified by the Buyer (by phone, SMS message or email). If the Buyer does not agree that the product of a particular Seller is replaced by a similar or similar product of another Seller, then the Seller, who is unable to deliver the product chosen by the Buyer, undertakes to immediately return to the Buyer the money paid by him no later than within 5 business days, if advance payment has been made, and in all cases withdraw the order.
7.7. In the event that, within 3 (three) working days from the submission of the offer, the Buyer, through one of the contacts indicated on the e-commerce website 99projects.eu, confirms that he agrees that the product will be replaced with a product sold by another Seller, the primary Seller undertakes to return to the Buyer the funds paid by him for the goods that the primary Seller cannot deliver and compensate for the difference in price.
7.8. If the Seller does not agree with the Buyer’s requirements, he is obliged, no later than 14 (fourteen) calendar days from the date of receipt of the Buyer’s request, unless the legal acts of the Republic of Lithuania and the European Union provide otherwise, to provide the Buyer with a comprehensive, reasoned written response.
7.9. The Seller undertakes to fulfill other obligations imposed regarding the Seller in the Rules and in the legal acts of the Republic of Lithuania.
- Prices for goods, payment procedures and terms
8.1. Prices for goods on 99projects.eu are indicated in euros, including the amount of VAT in force during the specified period of time in accordance with legal acts, as well as other taxes, if any, were applied.
8.2. For ordered goods, the Buyer can pay in one of the following ways (the choice may be limited, therefore the final list of payment methods applicable to the relevant order is indicated within the framework of the relevant order):
8.2.1. using electronic banking;8.2.2. by bank order;
8.2.3. in cash or by bank card during delivery/receipt; 8.2.4. using the service of concluding consumer loan agreements provided by leasing companies;
8.2.5. in other ways indicated on the website 99projects.eu.
8.3. When the Seller receives payment for the goods, or when confirmation regarding the financing of the purchase is received (when such a payment method is applied, and if the Buyer has chosen the payment method provided for in paragraphs 8.2.4-8.2.5 of the Rules), the order for the goods is confirmed.
8.4. The Buyer, by confirming the Rules, agrees that documents for the purchase of goods - VAT invoices, which at the same time are documents of the guarantee applied to the goods, can be provided to him physically along with the goods or electronically at the email address specified in the Buyer's registration form, immediately after execution of the order. VAT invoices indicate the Seller's details, selected goods, their quantity, discounts provided, the final price of goods, including all taxes, and other data, the provision of which is necessary, approved by legal acts regulating accounting.
8.5. VAT invoices for goods purchased by the Buyer may also be posted to the Buyer's Account on 99projects.eu. After the Buyer places an order, in the Account he will be able to see and print an order sheet - an invoice for prepayment.
8.6. The price of goods after the Seller has confirmed the order may change only in exceptional cases due to objective significant reasons beyond the Seller’s control (if there is evidence confirming these reasons). If the reasons for the price change are justified and in this case the Buyer does not agree to purchase the goods at the new price, the Buyer may refuse the order by informing the Seller about this through 99projects.eu within 2 (two) working days at the contacts indicated on the website electronically trade 99projects.eu. In the event of cancellation of an order in the manner provided for in this paragraph, the Seller undertakes to return to the Buyer all amounts paid by it for such canceled order. The validity of the reasons for the price change is assessed in each specific case.
8.7. If the Buyer has selected goods from several different Sellers, the Buyer’s basket of goods can be divided into separate baskets of goods for each Seller and with the formation of separate orders for such baskets. In the case of such division, the price of additional services per specific order (for example, delivery, bringing in goods, etc.) is proportionally divided into separate orders.
8.8. If the Buyer puts goods from several different Sellers into the basket, the Buyer’s basket of goods is divided and separate orders are formed for the purchase of goods from each Seller, i.e. The Buyer enters into a separate Agreement with each Seller. Accordingly, the implementation of each individual order and additional services included in the order are accordingly divided into separate orders, and therefore may differ from the price of services indicated in the description of a specific product.8.9. If the order amount is less than the specified amount, 99projects.eu has the right to apply an additional administration fee. The commission amount and the minimum cart amount are indicated when placing an order.
- Delivery of goods
9.1. When ordering goods, the Buyer may choose one of the delivery methods for goods specified in the specific offer of the goods sold by the Seller.
9.2. If the Buyer chooses the home delivery service during the order:
9.2.1. The buyer undertakes to indicate the exact place of delivery of the goods.
9.2.2. The buyer undertakes to accept the goods himself. When accepting goods, you must present a valid document confirming your identity (personal identification card, passport or new driver's license). If the Buyer does not accept the goods himself, although the goods are delivered to the address specified by the Buyer, the Seller has the right to transfer the goods to another person located at the address specified by the Buyer, and the Buyer has no right to make claims to the Seller regarding the delivery of goods to an improper person.
9.2.3. The goods are delivered by the Seller or his authorized representative.
9.2.4. The payment for the home delivery service does not include the delivery of ordered goods - the Buyer can order this service additionally.
9.3. If the Buyer, during the order, chooses to receive the goods at one of the branches of Lietuvos paštas (Lithuanian Post):
9.3.1. The buyer can pick up the goods at one of the branches of Lietuvos paštas (Lithuanian Post) by paying the specified payment for the redemption of the parcel. If the Buyer fails to pay the above payment, the goods will be returned to the Seller.9.3.2. The ordered goods must be picked up no later than within 3 (three) working days after the courier informed the Buyer by email or SMS that the goods can be picked up.
9.3.3. The goods can be collected not only by the recipient specified in the order, but also by another person specified at the time the order was submitted. When receiving goods, you must have with you and present to an employee of Lietuvos paštas (Lithuanian Post) a valid document confirming your personal identity (personal identification card, passport or new driver's license).
9.3.4. The service of receiving goods at Lietuvos paštas (Lithuanian Post) branches is not provided in the following cases:
9.3.4.1. If the total weight of the ordered goods is more than 20 (twenty) kg.9.3.4.2. If the overall dimensions of the goods ordered from the Seller do not allow this service to be provided.
9.4. If the Buyer, when submitting an order, chooses delivery of the Goods to an Omniva parcel locker or an LP EXPRESS self-service parcel terminal:
9.4.1. At Omniva parcel terminals or LP EXPRESS self-service parcel terminals, you can pick up goods that weigh less than 30 kg. Goods weighing more than 30 kg are not delivered to parcel lockers and self-service terminals.
9.4.2. The parcel must be picked up from the Omniva parcel terminal no later than 7 (seven) calendar days after the Seller informed the Buyer by email that the goods can be picked up. The parcel must be picked up from the LP EXPRESS terminal no later than within 5 (five) calendar days after the courier informed the Buyer that the goods can be picked up.
9.5. In exceptional cases, delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller, which the Seller could not control or reasonably foresee at the time of concluding the sales contract. In this case, the Seller undertakes to immediately contact the Buyer and agree on the terms of delivery of goods and other conditions.
9.6. The Seller is released from liability for violation of the terms of delivery of goods if the goods are not delivered to the Buyer or are delivered untimely due to the fault of third parties not related to the Seller and / or independent of the Seller, or due to circumstances depending on the Buyer.
9.7. During the delivery of goods to the Buyer, the Buyer is obliged, together with the courier or his authorized representative, to check the condition of the parcel and the product(s) and sign the parcel acceptance document. After the Buyer signs the delivery and acceptance document for the parcel, it is considered that the goods were delivered in proper condition, without damage, the basis of which does not relate to a manufacturing defect, and that there are no discrepancies in the configuration of the goods (s) (such that can be established during an external inspection of the goods ). If the Buyer notices that the product packaging is damaged (it is dented, wet or otherwise externally damaged), the product(s) are damaged and/or the product(s) are not properly assembled, the Buyer must note this in the acceptance document parcels and, with the participation of the courier or his representative, draw up a report of damage/discrepancies of the parcel and/or product(s) in free form. If the Buyer has not completed these actions, the Seller is released from liability for damage to the goods when the basis for such damage is not a manufacturing defect, as well as for inconsistencies in the configuration of the goods only if these inconsistencies can be determined during an external inspection of the goods.
9.8. The risk of accidental loss of goods or their damage passes to the Buyer from the moment the goods are transferred to the Buyer.
9.9. If, based on clauses 9.2 – 9.5 of the Rules, the Buyer does not pick up the goods within the established period, or they cannot be delivered to the Buyer, and the Buyer has paid for the goods and their delivery, representatives contact the Buyer regarding another time and / or method of delivery of the goods. If the Buyer still does not pick up the goods, or fails to deliver them,such goods are returned to the Seller, the order is canceled, and the Buyer is returned the money paid for the goods, minus bank charges applicable to the Seller for executed bank orders, payment for the delivery of goods, if applicable.
9.10. If, based on clauses 9.2 - 9.5 of the Rules, the Buyer does not pick up the goods within the established period, or they cannot be delivered to the Buyer, and the Buyer has not paid for the goods, such goods are returned to the Seller and the order is cancelled.
- Guarantees of the quality of goods and their shelf life for use
10.1. The properties of each product sold by the Seller on 99projects.eu are indicated in the product description attached to each product.
10.2. The goods offered by the Seller for purchase are of adequate quality. The product complies with the consumer purchase and sale agreement if:
10.2.1. the product corresponds to the description provided by the Seller and has the same properties as the product that the Seller provided as a sample or model when advertising the said product on 99projects.eu;
10.2.2. the goods are fit for use for the purpose for which goods of this kind are usually used;
10.2.3. the goods comply with the quality characteristics generally associated with goods of the same nature and which the Buyer can reasonably expect based on the nature of the goods and publicly made statements by the manufacturer of the item, its representative or seller, including advertising and labeling of the items, regarding the specific properties of the item.
10.3. 99projects.eu is not responsible for the fact that the goods sold by 99projects.eu may not correspond in size, shape, shade or other parameters to the actual size, shape, shade or other parameters of the goods due to the characteristics of the monitor used by the Buyer or other technical reasons , independent of the will of the Seller. Product photographs are for illustrative purposes only and are exemplary. Shades, inscriptions, parameters, measurements, sizes, functions and / or any other properties due to their visual characteristics may not look the same as in reality, so we ask you to be guided by the properties of the goods that are indicated in the product descriptions. The buyer is recommended to re-read the product description.
10.4. The seller provides a quality guarantee for different types of goods, valid for a certain time, the specific period and other conditions of which are indicated in the descriptions of such goods, or together with an invoice for the goods, which corresponds to the guarantee sheet.
10.5. The quality guarantee provided by the Seller does not limit or restrict the rights of consumers, which, in the event of purchasing a product or service of inadequate quality, are established for them by legal acts.
10.6. The seller does not provide warranty services for goods (with the exception of simple checks of the operation of goods that do not require special knowledge):
10.6.1. if the center(s) providing warranty service are located outside the Republic of Lithuania, the Seller will arrange for the Goods to be sent to such center(s);
10.6.2. if the center(s) providing warranty service are located in the Republic of Lithuania, the Buyer is directed to such center(s).
10.7. If the Buyer wishes to take advantage of the quality guarantee in relation to the media he purchased, he is individually responsible for the safety of the personal information contained on it, i.e. The warranty does not apply to information contained on storage media. Data on equipment provided for repair is usually deleted, unless the Buyer requests that the data be retained and it is technically possible to do so. Regarding the possibility of storing information contained on the medium, the Buyer and the Seller agree on a case-by-case basis separately.
10.8. In cases where, on the basis of legal acts, a certain period of suitability for use is established for specific goods, the Seller undertakes to sell such goods to the Buyer in such a way that he is given a real opportunity to use such goods before the expiration of the period of suitability for use.
- Right to withdraw from the sales contract
11.1. The right to withdraw from the sales contract in case of purchasing goods on the website www.99projects.eu:
11.1.1. The buyer, without specifying a reason, within 14 (fourteen) days has the right to withdraw from the remotely drawn up sales contract by notifying 99projects.eu. Please note that the Buyer cannot exercise this right by concluding one of the contracts specified in Part 2 of Article 6.22810Civil Code of the Republic of Lithuania regarding:
11.1.1.1. goods that are manufactured in accordance with the specifications specified by the Buyer or are clearly adapted to his personal needs;
11.1.1.2. goods that quickly deteriorate or have a short shelf life;
11.1.1.3. if the packaged goods are not suitable for return for health or hygiene reasons and which have been unpacked after delivery (for example: protective masks, face shields, etc.);11.1.1.4. goods which, due to their nature, are inseparably mixed with other items after delivery;
11.1.1.5. alcoholic drinks whose cost is established as part of the purchase and sale agreement and can be delivered only after 30 days, and the actual cost of the drinks depends on market fluctuations beyond the control of the merchant;
11.1.1.6. goods that were purchased on the basis of contracts in accordance with which the Buyer provided the Seller with a specific request for a visit to carry out urgent repairs or inspection. If in this case the entrepreneur provides more additional services than the Buyer specifically indicated, or sells more additional goods than are necessary to carry out repair work or inspection, the right to withdraw from the contract applies to these additional services or goods.
11.1.1.7. packaged video or audio recordings or packaged software equipment, if they were unpacked after delivery;
11.1.1.8. newspapers, periodicals or magazines, with the exception of subscription agreements for publications of this kind;
11.1.1.9. provided digital content not recorded on a physical medium, if delivery began with the Buyer's express consent given in advance and if he acknowledged that in connection with this he would lose the right to withdraw from the contract;
11.1.1.10. in connection with services that are provided to the Buyer in full, if before the provision of services there is an agreement and acknowledgment by the Buyer that he will lose the right to withdraw from the contract when the Seller has fully performed the contract.
11.2. Additional money back guarantee applied by the Seller
11.2.1. After the period of 14 (fourteen) days, but before the expiration of the period of 30 (thirty) days from the date of delivery or receipt of the goods, the Buyer has the right to take advantage of the additional money-back guarantee provided by 99projects.eu, if all returned goods are equipped with authentic labels, protective bags and are in the original packaging, the disposable packaging of the goods is not damaged, i.e. the goods have not lost the appearance in which they were sold. For a Buyer who participates in certain loyalty programs that provide more favorable conditions for an additional money-back guarantee, the provisions of such loyalty programs will apply. The Seller has the right, in the specific description of the product presented on 99projects.eu, to provide for a period of additional money-back guarantee. In all cases, the additional money-back guarantee (if applied by the Seller in relation to a specific product) will be implemented mutatis mutandis, adhering to the provisions of clauses 11.2.2-11.2.6. Rule
11.2.2. The Buyer must notify of the intention to use this guarantee (if applicable) within the period of such guarantee established by the Seller, calculated from the date of transfer of the goods to the Buyer. 11.2.5. The buyer has the right to return the goods by sending them to the addresses indicated on the e-commerce website 99projects.eu.
11.2.6. The additional money-back guarantee provided by the Seller is not available if the following products are ordered:
11.2.6.1. gift vouchers 99projects.eu;
11.2.6.2. packaged goods which have been unpacked after delivery and which are not suitable for return for health or hygiene reasons;
11.2.6.3. clothing for babies;
11.2.6.4. goods that were manufactured according to the Buyer’s individual order or obviously adapted for it, or which by their nature, after they are provided to the Buyer, can no longer be returned due to loss of marketability, are perishable, or their expiration date has expired;
11.2.6.5. shoes;
11.2.6.6. cloth.
11.3. Rules for replacement and return of goods of good quality
11.3.1. The buyer has the right, within 14 (fourteen) days from the date of delivery of the goods to him, to replace the purchased goods with similar goods of other sizes, shapes, colors, models or completeness. If a price difference arises when replacing goods, the Buyer is obliged to pay the Seller in accordance with the recalculated prices. The Buyer's notification of the desire to exercise the right provided for in this paragraph of the Rules, together with the returned goods, is sent by email to info@99projects.eu.
11.3.2 . In the event that the Buyer does not like the purchased goods, the shape, size, color, model or completeness of the purchased goods, replacement and return of the goods are made on the basis of the Retail Trade Rules approved by Resolution No. 738 of the Government of the Republic of Lithuania dated July 22, 2014. During the period, provided for in clause 11.3.1 of the Rules, the Buyer has the right to replace or return all goods that do not fall into the following list:
11.3.2.1. tobacco and tobacco products;
11.3.2.2. perfumery, cosmetic and toilet preparations;
11.3.2.3. photographic and cinematographic goods;
11.3.2.4. printed books, reproductions and other products of the printing industry;
11.3.2.5. fabrics;
11.3.2.6. carpet floor covering, with the exception of carpets and rugs;
11.3.2.7. knitted men's, boys', women's or girls' underwear;
11.3.2.8. clothing for babies;
11.3.2.9. stockings, socks, half-stockings and other similar products;
11.3.2.10. embroidered men's, boys', women's or girls' undershirts, nightgowns, pajamas and similar items;
11.3.2.11. bras, belts, corsets and similar products;
11.3.2.12. pearls, precious stones, precious metals and products made from them, with the exception of artificial jewelry;
11.3.2.13. machines and mechanical installations;
11.3.2.14. electrical machines and installations, devices for recording and reproducing sound, as well as recording and reproducing television images and sound;
11.3.2.15. ground vehicles;
11.3.2.16. ships, boats and floating devices;
11.3.2.17. optical, photographic, cinematographic, measuring, control, medical or surgical instruments and apparatus;
11.3.2.18. hours;
11.3.2.19. musical instruments;
11.3.2.20. weapons and ammunition;
11.3.2.21. furniture, bedding, lamps;
11.3.2.22. toys, games, with the exception of sports and fishing accessories;
11.3.2.23. works of art, collectibles and antiques;
11.3.2.24. plants, animals and food products of proper quality;
11.3.2.25. weighed and measured goods, which, at the request of the user, were specially prepared, cut, cut, etc.
11.3.3. Upon receipt of the goods, the Seller undertakes to replace it with the same product, only in the shape, size, color, model or completeness specified by the Buyer. If the Seller does not have a suitable replacement product, it will refund the Buyer the money paid for the product. The refund to the Buyer is carried out within 14 (fourteen) calendar days after the Seller received the Buyer’s notification of the desire to exercise this right, and if the Goods are not returned by the Buyer to the Seller within the time limits provided for in this paragraph, the period is calculated from the day the Goods are returned to the Seller.
11.3.4. Money for the goods is returned to the Buyer in the same way as the Buyer paid for the goods at the time of its purchase, unless the Buyer and Seller reach a different agreement. The Buyer in all cases has the right to demand that the money be returned to the bank account specified by the Buyer.
11.4. By taking advantage of the rights enshrined in clauses 11.1-11.3 of the Rules, the Buyer is refunded: the cost of the goods, administrative tax, if applicable, as well as the costs of delivering the goods (costs for returning the goods are not refunded).
11.5. If the Buyer purchased a set of goods on the website 99projects.eu, he is obliged to return the entire set of goods to the Seller, i.e. The Buyer may exercise the rights provided for the return of goods only in relation to all goods contained in the set.
11.6. If the Buyer has chosen a different method of delivery of goods than the cheapest one offered by the Seller, the difference created between the method of delivery of goods chosen by the Buyer and the cheapest method of delivery of goods to the Buyer is not returned.
- Procedure for returning and replacing goods of poor quality
12.1. Elimination of defects in sold goods, replacement, return of low-quality goods is carried out in the manner prescribed in the Rules, as well as taking into account the requirements of legal acts of the Republic of Lithuania.
12.2. If the Buyer purchased goods of inadequate quality, the Buyer has the right to demand one of the following methods of protection of rights:
12.2.1. for the Seller to eliminate defects in the goods free of charge within a reasonable time, if the defects can be eliminated;
12.2.2. so that the purchase price is reduced accordingly;
12.2.3. that the product be replaced with a similar product of proper quality, except in cases where the defects are minor or they arose through the fault of the Buyer;
12.2.4. return the paid price and refuse the sales contract when the sale of goods of inadequate quality is a significant violation of the order.
12.3. If the goods do not meet the quality requirements, first of all, the Buyer has the right to demand that the appropriate quality of the goods be ensured, and if this cannot be achieved, to demand a proportional reduction in the price of the goods or to terminate the sales contract unilaterally. To ensure the proper quality of the goods, the Buyer has the right to choose: to demand that the goods be repaired or to require that they be replaced, except in cases where the requirement cannot be fulfilled or the Seller will incur disproportionate costs in connection with this, compared to the costs of implementing another requirement, taking into account all the circumstances , including:
1) the cost of the goods, if the goods do not have defects;
2) the significance of the defects (non-conformity) of the goods;
3) whether the application of a different requirement will cause inconvenience for the Buyer.
12.4. The buyer has the right to demand a proportional reduction in the cost of the goods or termination of the sales contract only if:
12.4.1. The Seller did not repair or replace the product, either during repair or replacement of the product. The Seller did not agree to cover the costs of returning the product or the cost of removing and installing the product when the product was properly installed (installed, equipped or assembled) or the Seller refused to ensure proper quality. goods;

12.5. The buyer does not have the right to terminate the sales contract if the defect in the goods is minor.
12.6. If the Buyer wishes to return the goods, the following conditions must be met:
12.6.1. inform the Seller about this via the contact specified in the invoice, or 99projects.eu by email. email info@99projects.eu ; the notification must indicate the goods being returned;
12.6.2. provide a document confirming the purchase of goods and a document confirming the guarantee (if it was issued);
12.6.3. provide the request in free form and submit it to the Seller or 99projects.eu.
12.7. The Buyer may exercise the right to return goods of inadequate quality during the period of guarantee of the quality of the goods established in the document on its purchase, which is indicated by the Seller from whom the Buyer purchased the goods. When purchasing goods by Consumers, the quality guarantee of the goods in all cases is for a period of at least 2 years from the date of purchase of the goods.
12.8. Buyer must pay for shipping costs and return shipping costs. If the goods are returned due to inadequate quality, the Seller will refund the Buyer the shipping and return costs incurred by it.
12.9. 12.11. Separate rules for returning goods of inadequate quality from the Seller may be provided for in the warranty documents provided along with them. In the event of any discrepancy between these Rules and the rules applied by the relevant Seller, these Rules must be followed.
- Replacement and return of goods in case of delivery of the wrong goods
13.1. 13.2. The procedure for returning goods and money is provided for in paragraph 14 of the Rules.

15.3. 15.4. 15.5. 99projects.eu is not responsible for the proper fulfillment of mutual obligations of the Buyer and the Seller, whose goods or services the Buyer ordered through 99projects.eu.
- Marketing means used by 99projects.eu
16.1. The Seller, at his discretion, may initiate various promotions or games on 99projects.eu.
16.2. During certain promotions, 99projects.eu may provide Buyers with its virtual money - 99proEuras, which can be used to pay for goods purchased on 99projects.eu. Payment using 99proEuras for goods is possible if such a possibility is provided on the website 99projects.eu for a specific product.
16.3. If the Buyer purchases a product for which 99projects.eu additionally provides a certain amount of 99proEuras for the next purchase, and the Buyer has exercised the right to withdraw from the sales contract provided for in the Rules, the amount of 99proEuras provided to the Buyer under the above conditions is canceled.
16.4. If the Buyer, when purchasing the goods, spent a certain amount of 99proEuras to pay for the goods and exercised the right to withdraw from the sales contract provided for in the Rules, the spent amount of 99proEuras is returned to the Buyer. 18.2. The law of the Republic of Lithuania applies to relations arising on the basis of these Rules.
